Pila Battery Limited Warranty (USA)

Effective Date: January 31, 2025

WHAT PRODUCTS ARE COVERED

To be entitled to the benefits of this limited warranty (this "Limited Warranty"), your Pila Battery must: ( 1 ) be purchased from Pila Energy or a Pila Energy authorized reseller; and ( 2 ) have the following part numbers: MB-16-x, where “x” represents any alphanumerical code to describe the Pila Battery style and variant. This Limited Warranty complies with the Magnuson-Moss Warranty Act and applicable state consumer protection laws in the United States.

WHO CAN MAKE A CLAIM

This Limited Warranty is only available to the original purchaser of the Pila Battery and is non-transferable. Warranty coverage does not extend to any subsequent owners or transferees, except in cases where the original proof of purchase is provided by the subsequent owner within the Warranty Term.

WHAT IS COVERED AND FOR HOW LONG

Subject to the terms and conditions set forth in this Limited Warranty, each Pila Battery shall be free from defects in materials and manufacturing workmanship for a period of five ( 5 ) years commencing on the date of purchase, as evidenced by proof of purchase.

This Limited Warranty is automatically activated at the date of purchase, as evidenced by proof of purchase. No registration is required for standard warranty coverage.

However, to access enhanced warranty benefits, including remote support, firmware updates, and extended coverage, the Pila Battery must be registered within 180 days of purchase. Registration can be completed through the Pila App or by emailing Pila Energy Support at support@pilaenergy.com with:

Proof of purchase (receipt or order confirmation),
Pila Battery serial number, and
Owner’s contact information (name, email, and phone number).

Failure to register within 180 days will limit warranty coverage to basic protections, excluding firmware updates, remote diagnostics, and extended support.

YOUR SOLE REMEDY

If Pila Energy confirms the existence of a defect that is covered by this Limited Warranty, Pila Energy will, in its sole discretion, either:

(i) Repair your Pila Battery (using new or refurbished parts),

(ii) Replace your Pila Battery with an equivalent product (new or refurbished), or

(iii) Refund you the original purchase price of the Pila Battery, subject to reasonable depreciation.

A repaired or replacement product/part assumes the remaining warranty term of the original product or ninety (90) days from the date of replacement or repair, whichever provides longer coverage. When a product or part is exchanged, the replacement item becomes your property, and the replaced item becomes the property of Pila Energy.

MAKING A WARRANTY CLAIM

If you need to file a claim under this Limited Warranty, please submit a service request by contacting Pila Energy Support using the contact information set forth at the end of this document.

For a Limited Warranty claim to be processed, it must include:

(i) Proof of ownership of your Pila Battery linked through the Pila App;

(ii) A description of the alleged defect(s); and

(iii) Your Pila Battery’s part number and serial number (as printed on the product label).

Prior to returning any products, you must obtain a return authorization number from Pila Energy. Pila Energy will cover the cost of return shipping if the product is deemed defective under this Limited Warranty. All returned products must be securely wrapped and packaged as directed by Pila Energy Support to avoid shipping damage.

DISCLAIMER OF WARRANTIES

THIS LIMITED WARRANTY IS THE ONLY EXPRESS WARRANTY PILA ENERGY PROVIDES FOR THE PILA BATTERY, AND THE ABOVE REMEDY IS YOUR SOLE REMEDY. PILA ENERGY LIMITS THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS OR SUFFICIENCY FOR A PARTICULAR USE OR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE, TO THE DURATION OF THIS EXPRESS WARRANTY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PILA ENERGY SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, ORAL OR WRITTEN, STATUTORY OR OTHERWISE.

GENERAL EXCLUSIONS

This Limited Warranty does not apply to any defect or loss of product functionality resulting from:

(i) Abuse, misuse, improper handling, negligence, rust, or corrosion; (ii) Accidents or force majeure events, including lightning, flood, earthquake, fire, or other events beyond the reasonable control of Pila Energy; (iii) Non-compliance with the Pila Battery Owner’s Manual or other provided documentation; (iv) Unauthorized modification, tampering, or disassembly of the Pila Battery; (v) External damage such as impact, faulty or damaged building wiring, or incompatible components; (vi) Superficial defects, dents, or marks not affecting performance; (vii) Theft of the Pila Battery; (viii) Improper storage conditions, including storage outside recommended temperature and humidity ranges as outlined in the product documentation; (ix) Use beyond the intended purpose, including applications not described in the official Pila product documentation; (x) Removal or defacement of serial numbers; (xi) Combination with third-party products not authorized or approved by Pila Energy; (xii) Failure to register the Pila Battery within 180 days of purchase, except where limited coverage of two ( 2 ) years applies; (xiii) Damage caused by exposure to extreme temperatures, direct sunlight, water ingress, excessive humidity, dust, or corrosive chemicals beyond the environmental conditions specified in Pila Energy’s product documentation.

Battery Degradation Disclaimer:
This Limited Warranty does not cover normal capacity loss due to battery aging. However, Pila Energy warrants that your Pila Battery will retain at least 70% of its original capacity for five ( 5 ) years or 2,500 full charge-discharge cycles (whichever comes first), provided it is properly installed and maintained. If the battery is connected to the internet, Pila Energy Support may verify its State of Health remotely. If the battery is not connected, Pila Energy may request additional proof of usage for warranty claims. If capacity falls below this threshold under normal use, Pila Energy will repair, replace, or compensate you as outlined in this Limited Warranty.

COMMISSIONING & INTERNET CONNECTION

The Pila Battery is designed to operate with or without an internet connection. While internet connectivity is strongly recommended for optimal performance, firmware updates, and remote support, it is not required to maintain standard warranty coverage.

Customers who do not wish to connect their Pila Battery to the internet can maintain full warranty coverage by registering their battery within 180 days of purchase via the Pila App or by emailing Pila Energy Support at support@pilaenergy.com with:

Proof of purchase (receipt or order confirmation),
Pila Battery serial number, and
Owner’s contact information (name, email, and phone number).

Failure to register within 180 days will reduce the warranty period to two ( 2 ) years from the date of purchase. If a warranty claim is submitted, Pila Energy may request additional information to verify proper product use.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PILA ENERGY SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THIS LIMITED WARRANTY. PILA ENERGY'S LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR PILA BATTERY (EXCLUDING INSTALLATION COSTS).

LIMITATION OF USE

THE PILA BATTERY IS NOT INTENDED FOR LIFE-SUPPORT SYSTEMS OR OTHER CRITICAL APPLICATIONS WHERE PRODUCT FAILURE COULD LEAD TO INJURY OR LOSS OF LIFE.

APPLICABLE LAW

This Limited Warranty gives you specific legal rights, and you may have other rights that vary by state. Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages. In those states, certain limitations in this Limited Warranty may not apply to you.

This Limited Warranty is governed by the laws of the State of California, without regard to conflict of law principles. If any provision of this Limited Warranty is found to be unenforceable under applicable law, the remaining provisions will continue in full force and effect.
